DEFINITIONS
When the following words with capital letters are used in these terms, this is what they will mean:

We/Our/Us: Calagua Ltd (registered no. SC849195) whose registered office is at The Wake Yard, 75 N Canal Bank Street, Glasgow, Scotland, G4 9XP, trading as “The Wake Yard”.

Waiver: the full release and waiver of liability, assumption of risk and indemnity agreement provided to You by Us on the date of Your The Wake Yard Activity.

You/Your/Yourself: means the person signing the declaration forming part of this waiver.

Participant: refers to a person who has booked to participate in any activity by virtue of a booking.

The Wake Yard Activity: any activity which takes place on Our premises, including both Water Based Activities and Land Based Activities.

Group: individuals/the group of individuals, as listed on this waiver, for whom You are responsible.

Water Based Activities: any water‑based The Wake Yard Activity, including but not limited to Wakeboarding, Ringo.

Land Based Activities: any land‑based The Wake Yard Activity, offered by The Wake Yard.

Site: means the site on which the The Wake Yard Activity takes place.

LOSS & LIABILITY

We will not accept any liability for personal injury sustained by You from the use of Our premises or facilities, unless such injury is caused by Our negligence or the negligence of Our employees or subcontractors.

We can accept no responsibility for accidents or losses arising either directly or indirectly as a result of any medical condition or physical disability.

Personal Insurance – We have public liability insurance, which does not provide personal insurance cover (e.g., loss, damage, injury, accident) of any kind, meaning We will not be responsible for loss of or damage to property belonging to You.

Use of Our facilities, hire kit, and other relevant equipment provided by Us is at Your own risk, and We will not accept liability for any personal injury sustained due to misuse or manipulation of Our safety equipment.

You must complete and sign the Waiver prior to commencing any The Wake Yard Activity.

SAFETY & SUPERVISION
You must observe all directions, instructions, and requests from Us or Our staff at all times when taking part in or preparing for any The Wake Yard Activity.
​
All children under 16 years must have responsible, on‑site supervision at all times. Those on organised programmes/activities may be supervised by an appropriate coach, leader, or instructor supplied by Us.
​
For Water Based Activities, You must always wear a buoyancy aid or impact vest and a helmet. Wetsuits must be worn unless advised otherwise by Our instructors.
​
If You wish to use Your own safety equipment, You must ensure it is adequate for the prevailing conditions. We cannot accept any liability for personal injury or loss arising from failure or inadequacy of any equipment supplied by You.

ON-SITE CONDUCT
We may refuse to allow, or remove, a Participant from any The Wake Yard Activity if, in Our sole discretion, it is necessary for safety; no refund will be offered.
​
Consuming alcohol or drugs prior to participation is prohibited. Anyone suspected of being under the influence will be refused, and no refund will apply.
​
We may refuse participation or remove any Participant acting abusively towards Our staff or others on Site.​​

PARTICIPATION REQUIREMENTS
You must be confident in and around water and be able to swim at least 25 m unaided.
​
If You have suffered a concussion in the past 8 weeks or are pregnant, You are not permitted to participate.
Any medical condition or disability must be declared before participating.

Activities have age, height, and weight restrictions:

Wakeboarding: Min. age 6 years

Ringo: Min. age 6 years

Weight limit for all activities: 120 kg / 18.5 stone

CANCELLATION & MISCELLANEOUS

Individuals: Cancellations are not accepted however, sessions may be rescheduled up until 48 hours before the session, at which point, no changes are allowed.

Groups (6+ participants): 14 days’ notice required for rescheduling.

This Waiver contains important information about participation. By signing, You acknowledge and accept these terms.
Any dispute under this Waiver will be governed by Scottish law and subject to Scottish courts.

PHOTOGRAPHY, VIDEOGRAPHY, AND AUDIO RECORDINGS
​
During Your visit to The Wake Yard, Your image or voice may be captured by Us or our partners. Booking constitutes consent to such captures, including those of minors in Your Group.
​
Visitors may also take images on Site; We are not responsible for their use.
​

DECLARATION
I confirm I have read, understood, and agree to abide by the terms and conditions, including those found in the Booking Terms and Conditions at https://www.thewakeyard.com/terms-conditions, issued by Calagua Ltd trading as The Wake Yard, and accept them on behalf of each Participant.

I confirm I have the authority to accept these terms on behalf of each Participant, and where appropriate, their parent(s) or guardian(s).
By listing each Participant’s name, I confirm their booking and my acceptance of the Terms & Conditions on their behalf.
